> How a bank statement loan for second home buyers differs from investment financing: occupancy tests, distance rules, down payment and reserve rules.
A bank statement loan for a second home qualifies a self-employed buyer on deposits for a property they will use themselves part of the year. Lenders test that use: a one-unit home, suitable all year, under the borrower's control and usually some distance from the main residence. Pricing sits between a primary home and an investment property.

## What occupancy test does a bank statement loan for second home buyers face?

A second home bank statement loan requires the borrower to occupy the property for part of the year, keep control of it, and not run it as a rental business. Many non-QM lenders borrow the agency definition of a second home, then add their own overlays on distance and rental use.

### The agency definition lenders start from

[Fannie Mae's Selling Guide section on occupancy types](https://selling-guide.fanniemae.com/sel/b2-1.1-01/occupancy-types) sets out the standard test. A second home must be occupied by the borrower for some portion of the year, be a one-unit dwelling, be suitable for year-round occupancy and remain under the borrower's exclusive control. It must not be rental property or a timeshare, and it cannot be subject to an agreement that gives a management firm control over who occupies it.

A non-QM bank statement loan is not sold to Fannie Mae, so the lender is not bound by that text. Most lenders write a definition close to it anyway, because their investors expect it.

### Evidence a broker gathers for the occupancy test

The checklist below helps a broker show the lender that the home will really be used as a second home. It is an example list, and a lender may ask for more or less.

1. A signed occupancy statement or the second-home box on the application.
2. A reason the property suits personal use: a vacation area, family nearby or a work location the borrower visits often.
3. Confirmation the home is one unit and usable in every season.
4. Any rental or management agreement already in place, so the lender can judge it early.
5. The address of the primary residence and the distance between the two.

## Distance rules that separate a second home from the primary residence

Many lenders want a second home to be a meaningful distance from the borrower's primary residence, set as a minimum number of miles, or to sit in a recognised resort area. The rule is a lender overlay rather than a universal standard, so the figure differs from one lender to the next.

### Why distance matters

A house ten minutes from the borrower's main home is hard to explain as a getaway. Underwriters read it as a likely rental, and rentals carry more risk and a higher price. The distance rule is a quick filter for that risk.

### Exceptions a lender may accept

A lender may waive the distance rule with a reasonable explanation: a lake house in the same county, a condo near a hospital where a family member is treated, or a home close to a second business location. Write the explanation into the submission notes rather than waiting for the condition.

## Down payment, reserves and prepayment terms on a second home bank statement loan

Second home bank statement loans usually need a larger down payment than a primary home, often 10 to 20 percent or more depending on credit and loan size. Reserve rules are similar or slightly higher. The loan is still a consumer mortgage, which limits prepayment penalties in a way an investment loan is not.

### Down payment and reserves

Matrices typically cap second-home LTV five to ten points below the primary-home column. Reserves are counted in months of the second home's full payment, and many lenders add months for the primary residence too. The base checklist for score, reserves and history is in [the full list of bank statement loan requirements](/blog/bank-statement-loan-requirements).

### Prepayment penalties

A borrower comparing second-home and investment quotes may see a prepayment term on the investment quote that buys a lower rate. That trade usually is not available on a second home. Under [the CFPB's Regulation Z section 1026.43](https://www.consumerfinance.gov/rules-policy/regulations/1026/43/), a consumer mortgage secured by a dwelling may include a prepayment penalty only if it is a fixed-rate qualified mortgage that is not higher-priced. A non-QM bank statement loan on a second home does not meet that test. The investment-property side of the trade is explained in [how a bank statement loan prepayment penalty works](/blog/bank-statement-loan-prepayment-penalty).

### Interest-only options

Some second-home buyers want a lower early payment. Interest-only terms are offered on some second-home programs, and [how an interest only bank statement loan sets the payment and qualifies](/blog/interest-only-bank-statement-loan) explains why the borrower still qualifies on the higher amortizing payment.

### Co-borrower income from benefits

A second home is often bought later in life, with a spouse or partner whose income includes Social Security or a pension. Fair lending rules limit how a lender may treat that kind of income, and [Regulation B's rule on public assistance income](/blog/regulation-b-public-assistance-income) sets out what that covers.

## When should a second home bank statement file be written as investment property?

A second home file should be written as investment property when the borrower plans to rent the home for most of the year, wants rental income used to qualify, or hands occupancy control to a management company. Classing it as a second home in those cases misstates occupancy, which is a serious problem rather than a pricing shortcut.

### Occasional rental is not the same as a rental business

The Fannie Mae definition allows a lender to note rental income on a second home without disqualifying the loan, so long as that income is not used to qualify the borrower and the other second-home rules are met. Many non-QM lenders follow the same line. A family that rents its beach house for a few weeks in peak season is often still a second-home borrower. A family that lists it year-round on a booking platform is not.

### The pricing difference is real but secondary

Investment pricing is higher, and the borrower may resist it. Show both quotes. The borrower who chooses the investment program gains the option of a prepayment term and the use of rental income. The borrower who stays in the second-home program keeps the lower rate and must actually use the home.

Whichever program fits, the income figure comes from the same months of deposits. [TrueBankFlow](/) lines those statements up month by month and gives the average and the flagged transactions in a report for the file, so the program choice does not mean a second round of income work.
