> How child support income for a mortgage is verified: the court order, six months of deposits on bank statements and the three year continuance test.
Child support income can count for a mortgage when a court order or legal agreement sets the amount, bank statements show the payments arriving in full and on time, and the support will last at least three more years. Conventional loans want six months of received payments. Because the money is not taxed, many lenders gross it up.

## Which papers prove child support income for a mortgage?

The paper that proves child support income is the legal document that creates the obligation: a final divorce decree, a separation agreement, a court order or a state support order. The lender reads it for the monthly amount, the payment schedule and the event that ends support, usually a child's birthday. Statements alone are not enough.

Fannie Mae's [Selling Guide topic on alimony and child support](https://selling-guide.fanniemae.com/sel/b3-3.4-02/alimony-child-support-equalization-payments-or-separate-maintenance) accepts a divorce decree, a separation agreement if the divorce is not final, another written legal agreement or court decree, or proof of a state law that requires the payments. It also tells lenders not to count proposed or voluntary support when a separated borrower has no agreement in place.

### What the underwriter pulls from the order

- **The amount**, stated weekly, biweekly or monthly.
- **Who pays**, which should match the payer on the deposits or the state agency that forwards the money.
- **Each child's support end point**, by age, graduation or another event.
- **Any step-downs**, where support drops as each child ages out.
- **Modifications**, since a later order replaces the earlier figure.

### Voluntary agreements under FHA

FHA is more flexible on informal arrangements. The [HUD Single Family Housing Policy Handbook 4000.1](https://archives.hud.gov/offices/adm/hudclips/handbooks/hsgh/4000-1/HB-4000-1-2021-10-26.pdf) accepts a voluntary payment agreement as long as the borrower can show 12 months of receipt through canceled checks, deposit slips or tax returns. A conventional loan would not count the same payments.

## Six months of child support deposits on bank statements

Bank statements show that the support in the order is actually being paid. Fannie Mae wants the most recent six months of receipt, showing full, regular and timely payments, and lists bank statements, canceled checks and other electronic receipt as acceptable evidence. FHA asks for three months when the borrower has a decree or court order.

### Recognizing the deposit lines

Support paid through a state disbursement unit arrives as an ACH credit with the agency's name. Support paid directly by the other parent may come by transfer, check or a payment app. The second pattern needs a clean trail from the payer named in the order. A deposit from the other parent's new spouse or a relative will raise questions.

### A worked example

The order and deposits below are examples. The order requires 450 every two weeks for two children, born in 2014 and 2017, ending when each turns 18. The lender converts that to a monthly figure first: 450 × 26 ÷ 12 = 975.

| Month | Deposits | Total received | Full and on time? |
| --- | --- | --- | --- |
| April | 2 × 450 | 900 | Yes |
| May | 3 × 450 | 1,350 | Yes, a third payday fell in May |
| June | 2 × 450 | 900 | Yes |
| July | 2 × 450 | 900 | Yes |
| August | 2 × 450 | 900 | Yes |
| September | 2 × 450 | 900 | Yes |
| Six month total | 13 payments | 5,850 | Average 975 |

Monthly totals swing because a biweekly schedule produces two months a year with three payments. The six-month average matches the order, which is the test that matters.

### Support sent by payment app

A parent who pays through a payment app leaves a trail that is harder to read. The bank statement may show only a transfer from the app, not the person behind it. Ask the borrower for the app's own history for the same six months, filtered to the payer named in the order, so each credit can be tied to a name and a date. Memo lines help but are not proof on their own. [Peer to peer payments on bank statements](/blog/peer-to-peer-payments-on-bank-statements) explains how reviewers trace app credits back to a sender.

### Support split across two accounts

Some borrowers receive support into a separate account they keep for the children. That account's statements belong in the file for the support months, even if it is not used for reserves. Without them, the lender sees an order and no payments.

## Will the child support income last three more years?

Continuance means the support must keep coming for at least three years from the application date. The underwriter checks each child's age against the end point in the order. If the youngest child ages out in two years, that child's share fails the test, and so may the whole amount if the order does not divide it by child.

### Running the age check

Using the example above, the application date is October 2026. The older child, born in 2014, turns 18 in 2032, nearly six years out. The younger child turns 18 in 2035. Both pass. Had the older child been born in 2010, support for that child would end in 2028, inside the three-year window, and the lender would have to cut the qualifying figure to the amount that continues.

### Orders that go past 18

Some orders run to 19, to high school graduation or through college. Others continue indefinitely for a child with a disability. Read the clause rather than assuming 18. The order controls, not the state's default age.

### Proof of the children's ages

Birth certificates or the order itself usually show dates of birth. Lenders may ask for one of them when the order gives only an end date tied to an event, such as graduation.

## Grossing up nontaxable child support income

Grossing up adds an allowance to nontaxable income so it compares fairly with wages that are taxed before they reach the borrower. Child support is not taxable to the parent who receives it, so most programs allow it. The lender must document both the amount and the fact that it is not taxed.

### How much can be added

Fannie Mae's [general income guidance on grossing up](https://selling-guide.fanniemae.com/sel/b3-3.1-01/general-income-information) lets the lender add 25 percent of the nontaxable amount, or more if the taxes a similar wage earner would pay are higher, provided the income and its tax-free status are likely to continue. FHA caps the addition at the greater of 15 percent or the borrower's actual tax rate from the prior year.

### The example, grossed up

With 975 a month of support:

| Program | Gross-up | Qualifying support |
| --- | --- | --- |
| Conventional, 25 percent | 243.75 | 1,218.75 |
| FHA, 15 percent | 146.25 | 1,121.25 |

Those figures are examples. The gross-up only applies to the part of support that passes the continuance test.

## Late, partial or skipped child support deposits

Irregular receipt is the most common reason child support income is cut or refused. A conventional lender needs full and timely payments for the six months, so a gap or a short payment can stop the income from counting. FHA's rules give a path for irregular support by averaging it.

### How FHA handles inconsistent payments

Under HUD 4000.1, if support has not been received consistently for the most recent six months, the lender must average what was received over the previous two years. If the borrower has received support for less than two years, the average runs over the time of receipt. A borrower whose ex paid 975 for eight months, then 500 for four, would qualify on the average rather than the order.

### Back pay arriving as a lump sum

A parent who catches up on arrears may send one large deposit covering several months. That deposit proves the money was paid but not that it arrived on time. Underwriters often treat the catch-up as a sign of risk and look harder at the months that follow.

### Payments paused by a pending modification

If either parent has asked the court to change support, the current amount is uncertain. Disclose the motion. A lender will usually wait for the new order or count the lower of the two figures.

### Mistakes brokers make with support income

- Counting the order without checking that payments arrive.
- Missing the youngest child's end date because the order lists only the eldest's.
- Grossing up support that the lender has already cut for continuance.
- Forgetting that the borrower may also pay support for another child, which goes on the debt side, as covered in [child support payments on bank statements](/blog/child-support-payments-on-bank-statements).

## Child support income in personal and credit union loans

Lenders outside mortgages also count child support, but usually with lighter paperwork. A personal loan or auto lender may accept the order and recent deposits without a three-year continuance test, since the loan term is shorter. The core question is the same: is the money steady and likely to keep coming for the life of the loan?

### Credit unions and small balance loans

Credit unions often ask for the most recent statements and a copy of the order, then add support to income when sizing a personal loan. [Credit union personal loan underwriting](/blog/credit-union-personal-loan-underwriting) explains how those lenders weigh member history alongside stated income.

### Support next to variable pay

Support is usually fixed, which makes it easier to verify than wage income that moves month to month. Compare it with [tip income for a mortgage](/blog/tip-income-for-mortgage), where the amount changes every pay period, or with [commission income for a mortgage](/blog/commission-income-for-mortgage), which needs a two-year average. A borrower with both support and variable pay has one stable piece and one that needs history.

### Putting the deposits in front of the reviewer

Support deposits are easy to lose among transfers and app credits. [TrueBankFlow](/) groups deposits from the same source on a regular schedule and shows their cadence and average amount, so a reviewer can set the support stream beside the order and check the six months at a glance.
